Receivership & Guaranty Associations

Insurance insolvency, rehabilitation, and liquidation proceedings across the full spectrum of insurance companies — including receivership counsel work on a multi-billion dollar HMO wind-down, informed by direct service on state guaranty association boards and by hands-on receivership administration experience.

When an insurance company becomes financially impaired — a life insurer, a property & casualty carrier, a health insurer, or an HMO — the process that follows — rehabilitation or liquidation under state receivership law — is one of the most procedurally complex and high-stakes areas of insurance practice. Policyholder claims, provider contracts, reinsurance treaties, regulatory obligations, and guaranty association coordination all have to be untangled at once, under court supervision, with real people's coverage on the line.

Atlas brings a rare vantage point to this work. Co-founder John Matthews has served on the guaranty association boards that stand behind policyholders when an insurer fails. Co-founder Trey Sivley led a state insurance department's receivership and financial oversight functions and has directly administered significant insurance receiverships. Between them, Atlas covers the regulatory, legal, and operational dimensions of an insurance insolvency.

Atlas's receivership practice spans the full range of insurance companies. One current example: Atlas is serving as receivership counsel in the rehabilitation and liquidation of a $7B+ per year health maintenance organization — one of the most complex assignments of its kind in the country, and a role held in only a small number of specialized engagements nationally.
