Harry (“Trey”) Sivley, III

Harry (“Trey”) Sivley, III is the co-founder and managing attorney of Atlas Legal and Regulatory Solutions PLLC. An insurance regulatory lawyer and executive advisor, his career spans public service, private practice, corporate counsel, and receivership administration, bringing a combination of legal judgment, regulatory credibility, financial oversight experience, and operational leadership to complex insurance, healthcare, reinsurance, captive insurance, and insolvency matters.

Sivley began his career as a financial examiner with the Georgia Department of Insurance, conducting financial condition examinations and supporting the codification of NAIC statutory accounting principles. After earning his J.D. from Georgia State University College of Law, he practiced civil litigation before returning to the Department as Assistant Director of the Division of Insurance and Financial Oversight and Principal Enforcement Attorney, where he supervised examination-related legal matters, negotiated settlements, and advised on the implementation of the Affordable Care Act and the Non-Admitted and Reinsurance Reform Act — including leading the Department's successful application for an individual-market medical loss ratio adjustment.

In 2012, Sivley joined Locke Lord LLP's Regulatory and Transactional Insurance Practice Group, advising insurers, agencies, third-party administrators, and other regulated entities. His work included serving on the team representing a $5.7 billion health insurer acquisition, along with regulated entity formation, holding company act filings, intercompany transactions, NAIC monitoring, and ACA and Dodd-Frank compliance matters.

Sivley returned to the Georgia Department of Insurance in 2013 to lead its Division of Insurance and Financial Oversight, overseeing financial examination, market regulation, financial analysis, administrative supervision and receivership, and captive insurance functions statewide. He created the Department's Captive Insurance Company Section, managed relationships with the legislature, Governor's Office, and Attorney General, provided legislative testimony, and reorganized the Division to improve regulatory effectiveness.

From 2015 to 2023, Sivley served as Associate General Counsel and Director of Regulatory Affairs for UnitedHealthcare's Southeast Coast operations, counseling CEOs and executive leadership on regulatory strategy, enterprise compliance, and legislative priorities. He managed regulator relationships across Florida, Georgia, North Carolina, Puerto Rico, South Carolina, and the U.S. Virgin Islands, while monitoring NAIC activity and emerging legislation affecting the business.

Since 2023, Sivley has led and supported the administration of significant insurance receiverships as Director and Senior Director at Examination Resources, LLC — including a multi-billion dollar HMO receivership, working directly with appointed receivers and special deputy receivers. The role combines legal coordination, operational execution, regulatory compliance, contract negotiation, reinsurance analysis and settlement, recovery strategy, and coordination with attorneys general, outside counsel, guaranty associations, and state and federal regulators.

At Atlas, Sivley focuses on receiverships and insolvency, captive insurance, reinsurance, and complex regulatory transactions, including due diligence on insurer acquisitions.

Sivley is a veteran of the United States Marine Corps Reserve. He is a frequent presenter and moderator on insurance regulation, healthcare reform, captive insurance, NAIC statutory accounting, Dodd-Frank, Solvency II, and Affordable Care Act implementation, and co-author of publications including "Private Exchanges: Regulatory Morass or Panacea?" and "The Georgia Any Willing Provider Statute — Only a Blue Cross Issue?"
